Owner-approved version 1, approved 2026-10-01. Customer acceptance and live sales remain disabled until the controlled release checks pass.
1. About these terms
These terms govern access to the KXRA platform supplied by KXRA GROUP LTD, company number 17435511, whose registered office is 66 Paul Street, London, England, United Kingdom, EC2A 4NA (KXRA, we, us).
The service is offered only to organisations and people acting wholly or mainly for business purposes. It is not currently offered to consumers. The person accepting these terms confirms that they can bind the customer organisation.
2. The service
The founding subscription provides access to the KXRA Brand Studio and the usage allowance shown at checkout: 120 generated creative variants and 120 reviewed exports per monthly allowance period. Unused allowance does not roll over.
Ask KXRA, generated image or video media, high-cost research, integrations, custom development and other separately described services are excluded unless an accepted order expressly includes them.
3. Accounts and authorised users
The customer must provide accurate account information, keep sign-in credentials and multi-factor authentication secure, and promptly remove access for people who no longer need it. Accounts are personal to the authorised user and must not be shared.
KXRA may suspend access where reasonably necessary to protect the service, another customer or the security of data. KXRA will restore access when the reason for suspension is resolved where it is safe to do so.
4. Price, tax and renewal
The founding subscription is £29 per organisation per month or £290 per organisation per year. Prices exclude VAT and other applicable taxes, which will be identified before payment where chargeable.
The subscription renews automatically for the same billing interval until cancelled. Stripe processes subscription payments. KXRA does not receive or store full payment-card details.
5. Cancellation
The customer may cancel at any time through the billing portal or by contacting info@kxra-group.com. Cancellation takes effect at the end of the current paid billing period. The customer retains paid access until then and no further renewal is charged.
A cancellation request submitted after a renewal has completed applies to the next renewal unless KXRA confirms otherwise.
6. Refunds
Subscription fees are non-refundable for a billing period that has started, except for a duplicate or incorrect charge, where the law requires a refund, or where KXRA expressly agrees one after a material service failure. This does not limit any remedy that cannot legally be excluded.
Custom-project payments and refunds are governed by the accepted custom-project order and the Custom Project Terms.
7. Failed payments and grace period
If a renewal payment fails, KXRA may retry payment and will allow a seven-calendar-day grace period. During that period the service may continue. If payment remains overdue after seven days, generation and export functions may be suspended.
KXRA may provide read-only access for up to 30 days after the first failed payment to allow payment correction and data retrieval. KXRA may then suspend or close the workspace subject to the Privacy Notice and retention policy.
8. Customer content and permissions
The customer retains ownership of content it supplies. The customer grants KXRA a limited right to host, copy, process and display that content only to provide, secure and support the service and to comply with law.
The customer must have the rights and lawful basis needed to submit content. It must not submit unlawful material, malicious code, special-category personal data, confidential third-party material or regulated data unless KXRA has expressly agreed the relevant controls in writing.
9. AI-assisted output
AI-assisted output may be incomplete, inaccurate or similar to material produced for others. The customer must review output before relying on, publishing or using it. KXRA does not represent that output is unique, error-free, legally compliant or suitable for a regulated decision.
The service must not be used to make solely automated decisions with legal or similarly significant effects, to provide medical, legal or financial advice, or to execute trading, payment, employment or safety-critical decisions without an expressly agreed controlled service and qualified human review.
10. Acceptable use
The customer must not attempt to bypass permissions or usage limits, access another organisation's data, probe or disrupt the service, introduce malware, misuse another person's identity, infringe rights, generate unlawful or deceptive material, or use the service to train a competing model without written permission.
KXRA may investigate suspected abuse using proportionate security records and may suspend the affected capability while an investigation is active.
11. KXRA intellectual property
KXRA and its licensors retain ownership of the platform, software, workflows, templates, methods, branding and pre-existing materials. Subject to payment and these terms, KXRA grants the customer a non-exclusive, non-transferable right to use the service during the subscription.
No ownership of KXRA software or operating methods transfers to the customer. Rights in bespoke deliverables are governed by an accepted custom-project order.
12. Confidentiality
Each party must protect the other party's non-public business, technical and commercial information using reasonable care and use it only for the relationship. This does not cover information that is public without breach, already lawfully known, independently developed or lawfully received from another source.
A party may disclose confidential information where required by law after giving notice where legally permitted.
13. Availability and changes
KXRA will use reasonable care and skill to provide the service. The service may be unavailable for maintenance, security work, provider interruption or events outside reasonable control. No uninterrupted-availability commitment applies unless an order states one.
KXRA may improve or change features. A material reduction to a paid core feature will be notified in advance where reasonably possible. If a change materially disadvantages the customer, the customer may cancel before the next renewal.
14. Liability
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded.
Subject to that sentence, neither party is liable for indirect or consequential loss, lost profit, lost revenue, lost opportunity or loss of anticipated savings. KXRA's total aggregate liability arising from the subscription in any 12-month period is limited to the fees paid or payable for that subscription in that period.
The customer remains responsible for business decisions, published material, legal compliance and maintaining appropriate copies of its source content.
15. Ending the agreement
Either party may end the agreement immediately if the other commits a material breach and does not remedy it within 14 days after written notice, or becomes insolvent. KXRA may end access immediately for serious security abuse, unlawful use or attempted cross-tenant access.
On expiry or termination, access ends subject to any stated grace or retrieval period. Clauses intended to continue, including payment, confidentiality, intellectual property, liability and dispute terms, remain effective.
16. Notices and changes to these terms
Operational notices may be sent to the account email. Legal notices to KXRA must be sent to info@kxra-group.com. The customer must keep its contact details current.
KXRA may update these terms for legal, security or material service changes. Material changes will be notified before they take effect. Continued use after the notified effective date constitutes acceptance where permitted; otherwise KXRA will request fresh acceptance.
17. Governing law
These terms and any non-contractual obligations are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
